In this research writers discussed one of the problems about the legal status of BPRs BKD after former the rising of the law number 6 year 2014 about village .The purpose of this research to analyze described da legal certainty about the legal status of smallholder credit banks BPR (former village credit agency (BKD) transition system in the aftermath of the law number 6 year 2014 about the implications of the villages and on asset ownership and superintendence of BPRs former BKD. ` The research uses a method of this research is kind of approach used normative and research in this research approach is historical (historical approach) , (statute approach) legislative approach , and conceptual approach) (conceptual approach .The result of this research is legal certainty will BKD BPR former status .And the form of protection against the assets owned by former operational and supervision of BKD BPR away .

Abstrak

 

Dalam penelitian ini penulis membahas salah satu masalah tentang Status hukum dari BPR Eks BKD Pasca terbitnya Undang-Undang Nomor 6 Tahun 2014 Tentang Desa. Tujuan penelitian ini untuk mendeskripsikan da menganalisis kepastian hukum tentang status hukum  Bank Perkreditan Rakyat  (BPR) Eks Badan Kredit  Desa (BKD) pasca peralihan sistem Undang-Undang Nomor 6 Tahun 2014 tentang Desa serta implikasi terhadap kepemilikan aset dan pengawasan dari BPR Eks BKD. Metode penelitian menggunakan jenis penelitian ini adalah penelitian normatif dan pendekatan yang digunakan dalam penelitian ini adalah pendekatan historis (historical approach), pendekatan perundang-undangan  (statute approach), dan pendekatan konseptual  (conceptual approach). Hasil dari penelitian ini yaitu kepastian hukum akan status BPR Eks BKD. Dan bentuk perlindungan terhadap aset yang dimiliki oleh BPR Eks BKD serta pengawasan operasional kedepannya.
