Abstrak

Pada penulisan ini penulis mengkaji kekuatan mengikat dari The Montreux Document dalam mengatur pertanggungjawaban perilaku negatif Wagner Group PMC dalam upaya memenuhi kepentingan internal Rusia dalam peristiwa invasi Rusia ke Ukraina pada tahun 2022. Penulis mengangkat rumusan masalah, yakni: (1) Apakah The Montreux Document mempunyai peran untuk menahan perilaku negatif PMC? dan (2) Apakah perilaku negatif PMC Wagner Group pada Invasi Rusia ke Ukraina 2022 dapat dipertanggungjawabkan oleh negara penyewa sesuai dengan The Montreux Document? Penulisan ini menggunakan metode penelitian normatif dengan metode pendekatan perundang-undangan dan kasus. Penelitian ini menunjukkan bahwa The Montreux Document berpengaruh atas tumbuhnya kesadaran masyarakat internasional mengenai konsep good practices, khususnya dalam aktivitas PMC. Implikasi hukum secara tidak langsung muncul melalui suatu pembentukan hukum kebiasaan baru dalam bentuk gentleman’s agreement. Sebagai sebuah entitas bisnis yang menawarkan jasa tenaga militer, Wagner Group PMC telah memenuhi persyaratan dari The Montreux Document. Atas perihal ini, posisi Rusia yang menolak menjadi anggota The Montreux Document menjadi penghalang untuk penerapan The Montreux Document. Karena itu, komunitas internasional harus bekerja sama untuk mencipatkan suatu kebiasaan internasional yang dapat menumbuhkan keanggotaan The Montreux Document menjadi umum. Dengan didukung oleh pengawasan aktif organisasi antar pemerintah, PMC Wagner Group melalui keikutsertaan aktif Rusia dapat dipertanggungjawabkan tindakan negatifnya.

Abstract

This research seeks to investigate the binding force of the Montreux Document in the regulation concerning the accountability of the negative act taken by Wagner Group PMC in satisfying Russian internal interest in Russia’s invasion of Ukraine in 2022. This research aims to investigate the following problems: (1) does the Montreux Document play a role in holding the negative act committed by PMC; (2) can the state as the lessee be held accountable for this negative act by PMC Wagner Group according to the Montreux Document? This research employed a normative method and statutory and case approaches. The research results reveal that the Montreux Document affects the awareness among international members of the public in the concept of good practices, particularly regarding the activities of PMC. It leaves legal implications for the formulation of new norms in the form of gentleman’s agreement. In terms of the business entity offering military services, Wagner Group PMC has fulfilled the requirements set by the Montreux Document. Concerning this matter, the Russian position refusing to be a member of the Montreux Document presents an obstacle to the implementation of the Montreux Document. It is, therefore, pivotal that international communities cooperate to create international norms that carry the capability of transforming the membership of the Montreux Document into being general. With the support of active supervision of inter-government organisations, the PMC Wagner Group can take responsibility for the negative act through the active participation of Russia.
