PERLINDUNGAN HUKUM TERHADAP KONSUMEN TERKAIT PENGGUNAAN KLAUSULA EKSONERASI DALAMTERMS AND SERVICES JASA TRANSPORTASIONLINE

Abstrak

Permasalahan hukum dalam penelitian ini terkait dengan perlindungan hukum terhadap konsumen terkait penggunaan klausula eksonerasi dalam Terms and Services yang disediakan oleh penyedia jasa transportasi Go-Jek.Hasil dari penelitian ini menunjukkan bahwa Perlindungan hukum terhadappengguna jasa yang dirugikan akibat adanya klausula eksonerasi dalam termsand services dari aplikasi penyedia jasa transportasi online Go-Jek adalahdengan perlindungan hukum preventif dan represif. Perlindungan hukum secarapreventif lebih menitik beratkan kepada pembuatan aturan guna mencegahterjadinya pelanggaran. Aturan yang terdapat guna melakukan pencegahanterhadap adanya klausula eksonerasi adalah Pasal 18 Undang-UndangPerindungan Konsumen yang secara tegas menyatakan bahwa “tujuan darilarangan pencantuman klausula baku yaitu bahwa larangan ini dimaksudkanuntuk menempatkan kedudukan konsumen setara dengan pelaku usahaberdasarkan prinsip kebebasan berkontrak.â€Â  Sedangkan perlindungan represifyang lebih memfokuskan kepada pembalasan dari perbuatan merugikan pihaklain yang dibebankan kepada pihak tertentu. Dalam hal ini Penulis berpendapatbahwa perlindungan represif dapat dilakukan dengan pemberian sanksi baiksanksi administratif yaitu berupa teguran tertulis, denda, sampai denganpencabutan ijin untuk beroperasi kepada pihak penyedia jasa transportasi onlineGo-Jek juga dengan kewajiban untuk melakukan pembayaran ganti rugi kepadapihak pengguna jasa yang merasa dirugikan dengan adanya kesalahan yangtidak tertanggung akibat dari adanya klausula eksonerasi. Selebihnya sanksi inidapat diberikan kepada pihak penyedia jasa transportasi online Go-Jek dengandidahului dengan adanya gugatan ganti kerugian dari pihak pengguna jasa yangmerasa dirugikan dengan adanya klausula eksonerasi tersebut dan telahmendapatkan putusan dari Hakim yang telah berkekuatan hukum tetap.

Abstract

The legal issues in this study are related to legal protection for consumers related to the use of the exonation clause in the Terms and Services provided by Go-Jek transportation service providers. The results of this study indicate that the legal protection for service users who are disadvantaged due to the exoneration clause in the terms and services of the Go-Jek online transportation service provider application is through preventive and repressive legal protection. Preventive legal protection focuses more on making rules to prevent violations. The rules that exist to prevent the existence of an exonation clause are Article 18 of the Consumer Protection Law which explicitly states that "the objective of the prohibition on the inclusion of standard clauses is that this prohibition is intended to place the consumer on an equal footing with business actors based on the principle of freedom of contract." Meanwhile, repressive protection that focuses more on retaliation for actions that harm other parties is imposed on certain parties. In this case, the author argues that repressive protection can be carried out by imposing administrative sanctions in the form of written warnings, fines, to revocation of permits to operate to Go-Jek online transportation service providers as well with the obligation to make compensation payments to service users. who feel aggrieved by an error that is not covered due to the exonation clause. The rest of this sanction can be given to the online transportation service provider Go-Jek, preceded by a claim for compensation from the service user who feels aggrieved by the exoneration clause and has received a verdict from a judge.
