Abstrak

Penghilangan paksa sebagai kejahatan pelanggaran HAM berat akhirnya mendapatkan perhatian dari dunia internasional dengan dibentuknya International Convention For The Protection Of All Persons From Enforced Disappearance (ICPPED) pada tahun 2007, meski begitu hingga penelitian ini dibuat Indonesia masih berstatus negara penandatangan karena belum dilakukannya ratifikasi oleh pemerintah Indonesia sebagai bentuk pengikatan diri oleh pemerintah Indonesia, sebagai konvensi yang tidak memiliki kekuatan mengikat (jus cogens) penerapan konvensi ini di Indonesia dinilai tidak efektif terbukti dengan maraknya terjadi impunitas terhadap praktik penghilangan paksa, tidak tepatnya penegakan hukum dan sanksi terhadap praktik penghilangan paksa sesuai amanat hukum internasional dikarenakan tidak adanya instrumen hukum nasional yang mengatur mengenai penghilangan paksa. Berdasarkan hasil penelitian, International Convention for the Protection of All Persons from Enforced Disappearance (ICPPED) penting untuk segera diratifikasi oleh Indonesia sebagai wujud tindakan preventif, represif dan korektif Pemerintah Indonesia terhadap kejahatan Penghilangan Paksa sebagai tindakan Pelanggaran HAM berat.

Abstract

Enforced disappearance deemed as a serious violation of human rights receives attention worldwide, and this is indicated by the establishment of International Convention Fort The Protection Of All Persons From Enforced Disappearance (ICPPED) in 2007. However, to the time this research was conducted, Indonesia has been as a signing country since no ratification has been performed by the Indonesian government. As a convention that holds no binding power (jus cogens), the implementation of the convention in Indonesia is deemed ineffective. This is apparent when the incidence of impunity concerning enforced disappearance is rising. This issue is due to the absence of national legal instrument that governs enforced disappearance. From the analysis, it can be concluded that the ICPPED needs to be immediately ratified by Indonesia as preventive, repressive, and corrective measures of the Indonesian government concerning enforced disappearance categorised as serious violation of human rights.
