ABSTRAK

Penelitian ini bertujuan untuk mengetahui serta menganalisis mengenai orisinalitas dan legalitas karya cipta sebuah lagu yang dihasilkan dari pemanfaatan teknologi artificial intelligence audio deepfake menurut Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Adapun jenis penelitian yang digunakan penulis adalah penelitian normatif. Data dikumpulkan dengan teknik kepustakaan untuk kemudian dianalisis menggunakan metode yuridis normatif dengan pendekatan konseptual, pendekatan perundang-undangan, dan pendekatan kasus. Sumber hukum yang digunakan merupakan sumber hukum primer, sekunder, dan tersier dengan menggunakan cara studi kepustakaan kemudian dianalisis oleh penulis menggunakan penafsiran sistematik, ekstensif, dan komparatif  Berdasarkan hasil penelitian dapat diketahui bahwa karya lagu audio deepfake telah memenuhi persyaratan orisinalitas berdasarkan prinsip originalitas dalam perspektif Undang-Undang No 28 Tahun 2014 tentang Hak Cipta yang sejalan dengan prinsip sweet of the brow doctrine, modicum of creativity doctrine, the idea-expression dichotomy , Principle of Circumstantial Evidence, dan Principle of The independent creations. Meskipun telah memenuhi persyaratan mengenai orisinalitas namun legalitas karya lagu audio deepfake bersifat tentatif terdapat beberapa persyaratan yang harus dipenuhi agar lagu audio deepfake mendapatkan perlindungan hak cipta yakni mendapatkan izin dari pihak yang citranya digunakan sebagai konten deepfake, tidak melanggar hak ekonomi dan hak moral pelaku pertunjukan, serta tidak bertentangan dengan ketertiban umum.

ABSTRACT

This research aims to analyze the originality and legality of a song created by utilizing audio deepfake as Artificial Intelligence according to law number 28 of 2014 concerning Copyright. All the data were obtained from library research and analyzed based on normative-juridical methods with statutory, conceptual, and case approaches. The primary, secondary, and tertiary data were studied and analyzed based on systematic, extensive, and comparative interpretations. The research results reveal that deepfake audio has met the requirements of originality according to the principle of originality in the perspective of Law Number 28 of 2014 concerning Copyright, and this is in line with the principles of sweet of the brow doctrine, modicum of creativity doctrine, the idea-expression dichotomy, circumstantial evidence, and independence creations. Despite the fulfilled requirements of the originality, the legality of the creation of the song utilizing deepfake is tentative since some requirements have to be met to allow for the protection of the copyright where a permit can be given by the party whose creativity is being used in the content of deepfake, and it is not deemed to have violated the economic and moral rights of the party using the song and not deemed to have contravened the public order.
