ABSTRACT

As one of the intellectual property rights protected by law, copyright is the exclusive right ofthe creator that arise automatically based on the principle of declarative after an invention isembodied in a tangible form without prejudice to the restrictions, especially in this paperfocuses on copyright of computer software that are still widely infringed by both individualsand business entities. The author raises the problem regarding the form of legal protectionagainst a manufacturing company as a licensor of AutoCAD software with an alleged copyrightinfringement case against him, PT. Guna Era Manufaktura Bekasi as the software licensor wassuspected in committing infringements in the form of duplication of copyright, which occursbased on the results of research by related parties who have the authority over it.

ABSTRAK

Sebagai salah satu komponen yang dilindungi oleh hukum, Hak Cipta merupakan sebuah hakeksklusif pencipta yang timbul secara otomatis berdasarkan prinsip deklaratif setelah suatuciptaan nya diwujudkan dalam bentuk yang nyata tanpa mengurangi pembatasannya, yangdalam penulisan ini, lebih dikhususkan kepada hak cipta software komputer yang masihbanyak dipersalahgunakan baik oleh individu maupun badan usaha. Penulis menangkatpermasalahan mengenai bentuk perlindungan hukum terhadap suatu perusahaan industrimanufaktur sebagai pemegang lisensi software AutoCAD dengan adanya dugaan kasuspelanggaran Hak Cipta terhadapnya, PT. Guna Era Manufaktura Bekasi selaku pemeganglisensi software tersebut diduga melakukan pelanggaran berupa pengandaan hak cipta, yangmana hal tersebut timbul berdasarkan hasil penelitian oleh pihak terkait yang memilikiwewenang terhadapnya.
