ABSTRAK

Tahun 1960 masyarakat Bojong Koneng menerima surat garap dari negara setelah HGU PTPN XI habis masa. Sejak 1960 banyak masyarakat Bojong Koneng yang melakukan jual beli lahan eks HGU PTPN dengan surat oper alih garap. Salah satu jual beli yang terjadi adalah jual beli Rocky Gerung dengan Andi Junaedi pada tahun 2009. Tahun 2021, PT. Sentul City melakukan somasi dengan dasar kepemilikan SHGB kepada beberapa warga yang diduga menempati lahan milik PT. Sentul City. Somasi tersebut meminta masyarakat untuk segera mengosongkan lahan dalam kurun waktu 7 x 24 jam. Masyarakat yang menerima somasi merasa dirinya juga berhak atas tanah tersebut, karena telah menguasai secara fisik sejak tahun 1960. Penelitian ini menggunakan metode yuridis normatif, serta pendekatan undang-undang (statur approach) dan pendekatan kasus (case approach), dan pendekatan konseptual dengan menggunakan bahan hukum primer dan skunder. Dari kedua bahan hukum tersebut akan digabungkan dengan menggunakan analisis deskriptif, dengan memeparkan hasil analisis secara rinci dengan menggunakan kalimat deduktif. Hasil penelitian menunjukkan bahwa jual beli antara pemegang hak garap (penjual) dengan Rocky Gerung (pembeli) adalah sah. Hal ini dikarenakan berdasarkan hukum kebiasaan setempat, memperbolehkan hal tersebut. Peralihan hak garap tersebut memiliki bukti berupa surat pernyataan oper alih. Selain itu, proses peralihan hak dilakukan di hadapan kepala desa dan saksi. Namun, surat perrnyataan oper alih garapan tidak dapat dijadikan sebagai bukti peralihan hak atas tanah. Sementara itu, bukti milik PT. Sentul City, berupa sertifikat tanah, dalam Pasal 32 ayat (1) PP No. 24 Tahun 1997 tentang Pendaftaran Tanah, memiliki kekuatan pembuktian yang kuat. Tetapi, secara prosedural sertifikat tanah tersebut dapat diajukan gugatan pembatalan sertifikat. Gugatan tersebut, harus memperhatikan ketentuan Pasal 32 ayat (2) PP No. 24 Tahun 1997 tentang Pendaftaran Tanah.

ABSTRACT

In 1960, the locals of Bojong Koneng received a tenure letter from the state after the Right-to-Cultivate of PTPN (henceforth referred to as HGU PTPN) was overdue. Since then, a lot of locals of Bojong Koneng did the sale and purchase of the lands previously owned by HGU PTPN under the statement of tenure transfer. The case of Rocky Gerung and Andi Junaedi is one of these cases happening in 2009. In 2021, PT. Sentul City sent somatie (legal notice) on the ground of the ownership of the Building Right Title Certificate (SHGB) to some locals allegedly residing on the lands of PT. Sentul City. This somatie required the people concerned to leave the lands within 7 x 24 hours. The people receiving this somatie also believed that they had the rights to the lands, considering that they physically have had these lands since 1960. This research used normative-juridical methods and statutory, case, and conceptual approaches with both primary and secondary data. These two types of data were combined based on descriptive analysis by elaborating analysis results with deductive sentences. The research results show that the sale and purchase between the tenure right holder (seller) and Rocky Gerung (buyer) is legal simply because the local law allows this practice. The transfer of tenure right also adheres to the proof of transfer statement, and the process of transfer took place in the presence of the Village Head and witnesses. On the other hand, the transfer statement of this tenure right cannot serve as proof of transfer of the land right, while PT. Sentul City holds the freehold title of the land that has legal force, as in line with Article 32 Paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration. In a procedural scope, however, one can request for the revocation of this freehold title as long as the lawsuit filed concerning this case complies with the provision of Article 32 Paragraph (2) of Government Regulation Number 24 of 1997 concerning Land Registration.
