ANALISIS YURIDIS PUTUSAN NOMOR 474/PID.SUS/2020/PN.JKT.BRT TERKAIT PENERAPAN HUKUM TINDAK PIDANA TERORISME OLEH PEREMPUAN

ABSTRAK

Dalam Putusan Nomor 474/Pid.Sus/2020/PN.Jkt.Brt perlu dilakukan analisa demi mencapai kepastian hukum mengenai unsur-unsur tindak pidana terorisme yang ada. Kemudian, vonis terdakwa dalam putusan tersebut juga terasa begitu berat mengingat vonis pidana penjara selama 9 tahun. Sehingga penulis memiliki 2 rumusan masalah untuk menjawab kepastian terhadap unsur tindak pidana terorisme dalam putusan tersebut, yaitu mengenai analisa pertimbangan hakim serta meninjau putusan dari segi teori keadilan. Untuk menjawab permasalahan tersebut penulis menggunakan jenis penelitian yuridis normatif dengan pendekatan penelitian peraturan perundang-undangan, kasus dan konseptual. Dari hasil analisa penulis, pertimbangan Majelis Hakim Putusan Nomor 474/Pid.Sus/2020/PN.Jkt.Brt tidak sepenuhnya mempertimbangkan posisi terdakwa dalam kasus ini, terlebih posisi terdakwa sebagai seorang istri dan ibu dari anaknya. Hal tersebut dikarenakan tidak adanya pertimbangan hakim mengenai alasan pemaaf atau alasan yang dapat meringankan, sehingga terdapat disparitas dengan putusan-putusan pengadilan sebelumnya seperti yang dialami oleh Umi Delima yang seorang istri pimpinan terorisme di Puso hanya dijerat vonis 3 tahun karena telah memberi pembantuan terhadap suaminya selaku Ketua dari organisasi terorisme, serta berbagai putusan terdahulu yang tidak melebihi vonis seberat Fitria Diana. Namun dari sisi pertimbangan hakim terhadap pemenuhan unsur-unsur tindak pidana terorisme yang dilakukan oleh terdakwa sudah tepat dan terbukti karena terdakwa memang membantu seorang suami dengan secara langsung untuk melakukan tindak pidana terorisme terhadap Menkopolhukam yang merupakan pejabat publik dan telah menimbulkan berbagai luka-luka terhadap Wiranto dan pengawalnya.

ABSTRACT

Court Decision Number 474/Pid.Sus/2020/PN.Jkt.Brt needs a further analysis for the sake of legal certainty regarding the aspects to be considered in terrorism. The verdict imposed under this court decision is deemed too severe since the defendant was sentenced to nine-year imprisonment. Departing from this issue, this research aims to investigate 2 problems regarding the analysis of the judge’s consideration and the review of the decision from the perspective of justice theory. Normative-juridical methods and statutory, case, and conceptual approaches were employed. The analysis results indicate that the court decision mentioned above does not fully consider the position of the defendant in the case concerned, especially in the condition where the defendant is a wife and a mother to her child. There was no judge’s consideration regarding the alleviating grounds, and this absence has been the cause of dissenting decisions as experienced by Umi Delima, a wife of a terrorist leader in Puso, who was only sentenced to three-year imprisonment due to her position as an accomplice to her husband as a terrorist organization leader. That is, previous court decisions never resulted in verdicts imposing heavier punishment than the case faced by Fitria Diana. However, in terms of the judge’s consideration regarding the aspects of terrorism is deemed relevant recalling that the defendant was proven to serve as a direct accomplice to her husband in terrorism taking the Minister of Political, Legal, and Security Affairs of the Republic of Indonesia, a public official, as the victim and it also injured Wiranto and his bodyguards.
