ANALISIS PRINSIP ORIGINALITAS PADA KARYA VIDEO KLIP YANG DIDUGA MENIRU KARYA MILIK ORANG LAIN MENURUT UNDANG-UNDANG NOMOR 28 TAHUN 2014 TENTANG HAK CIPTA

ABSTRAK

Ada beberapa kasus plagiarisme video klip di Indonesia, salah satunya adalah video klip penyanyi dangdut Via Vallen yang berjudul “Kasih Dengarkanlah Aku” yang dianggap plagiat video klip solois wanita asal Korea Selatan bernama IU yang berjudul “Above the Time”. Tidak hanya itu, terdapat juga beberapa kasus seperti Young Lex yang melakukan plagiarisme terhadap video klip EXO. Sehingga penulis ingin melakukan penelitian dengan dua rumusan masalah, yaitu 1. Bagaimana batasan karya video klip yang dianggap melanggar prinsip-prinsip originalitas ketika karya tersebut diduga meniru karya milik orang lain menurut prinsip originalitas dalam Hak Cipta? 2. Apakah pengaturan prinsip originalitas karya video klip di Amerika Serikat dapat diterapkan di Indonesia untuk melindungi atau memperbaharui UU Hak Cipta Indonesia. Jenis metode penelitian yuridis normatif. Sehingga penulis mendapatkan hasil bahwa batasan plagiarisme karya sinematografi di Amerika Serikat menurut Copyright Law of The United States and Related Laws Contained in Title 17 of the United States Code ini menggunakan pendekatan terhadap 4 hal, yaitu mengenai tujuan dan karakter penggunaan, termasuk apakah penggunaan tersebut bersifat komersial atau untuk tujuan pendidikan; sifat dari karya hak cipta; jumlah dan substansi bagian yang digunakan sehubungan dengan karya hak cipta secara keseluruhan; dan pengaruh penggunaan terhadap pasar potensial atau nilai dari karya hak cipta. Sehingga dari adanya ketentuan mengenai penggunaan wajar tersebut dapat diketahui bahwa tingkat plagiarisme diukur melalui jumlah dan substansi bagian yang digunakan secara keseluruhan serta tujuan dari penggunaan karya tersebut. Dari peraturan tersebut, negara Indonesia seharusnya perlu menggunakan ketentuan tersebut untuk diberlakukan, karena ketentuan tersebut terasa lebih efektif dari apa yang diatur di Indonesia.

ABSTRACT

There have been several cases of plagiarism of video clips in Indonesia, and a video clip showing Via Vallen, a dangdut singer with the song title “Kasih Dengarkanlah Aku” is deemed to have plagiarized the clip of a soloist, IU, from South Korea with the song title “Above the Time”. For more cases, Young Lex is one of many plagiarizing the video clip of EXO. Departing from this issue, this research aims to investigate the following problems: 1. What makes a video clip considered violating originality principles in copyright? 2. Can the regulatory provisions concerning originality principles in the US be applied in Indonesia to protect and revise the Law concerning Copyright in Indonesia. This research employed normative-juridical methods, revealing that the scopes of plagiarism of cinematography in the US, according to Copyright Law of the United States and Related Laws contained in Title 17 of the United States Code, refer to approaches to four matters, constituting the objectives and the characteristics of the use, including whether this use is commercial or for the sake of education; the nature of copyright, the quantity and substance of the part used regarding the copyright creation as a whole; and the influence of the use on potential market or the values of the copyrighted work concerned. From this regulation, Indonesia needs to refer to this provision for further application since this provision is deemed to be more effective than what has been applied in Indonesia.
