ABSTRAK

Permasalahan yang diangkat ialah pengawasan terhadap tenaga kerja anak yang dinilai tidak maksimal dalam mewujudkan perlindungan hak-hak anak yang bekerja, karena pegawai pengawas ketenagakerjaan yang sedikit mengakibatkan perlindungan hak-hak anak menjadi terabaikan karena pemerintah Provinsi Kalimantan-Utara kurang mendukung dalam sarana dan prasarana untuk program pengawasan tenaga kerja anak yang mengakibatkan beberapa kendala-hambatan yang dialami oleh Disnaker dan Transmigran Prov Kalimantan-Utara, sehingga pengawasan pada pekerja anak ini dinilai kurang maksimal. Dari latar belakang tersebut, selanjutnya dikemukakan rumusan masalah yaitu,(1) Bagaimana pelaksanaan pengawasan ketenagakerjaan pada  tenaga kerja anak agar mewujudkan perlindungan atas berbagai hak anak di wiayah Kaltara, dan(2) Apa saja kendala yang dihadapi oleh Dinas Tenaga Kerja dan Transmigrasi Provinsi Kalimantan Utara saat melakukan pengawasan tenaga kerja anak untuk melindungi hak-hak anak yang bekerja beserta solusinya. Jenis penelitian yang digunakan ialah yuridis empiris yaitu penelitian hukum melalui studi  lapangan, dalam pendekatan yuridis sosiolois yaitu dengan melihat kenyataan hukum didalam masyarakat dan juga menggunakan analisis data deskriptif kualtatif. Proses pelaksanaan pengawasan tenaga kerja di Provinsi Kalimantan-Utara masih kurang berjalan baik, ditinjau dari berbagai permasalahan selama pelaksanaan pengawasan tenaga kerja. Permasalahannya antara lain: kondisi geografis Provinsi Kalimantan Utara, pengusaha yang menyembunyikan data pekerja anak,tenaga pengawas yang sedikit, kurangnya dana untuk memantau pekerja anak, dan kurangnya sarana dan prasarana dalam pelaksanaan pengawasan tenaga kerja anak. Untuk menyederhanakan pelaksanaan pengawasan ketenagakerjaan di Provinsi Kaltara, pemprov dan Disnaker Kaltara perlu: mengkoordinasikan berbagai pihak-pihak yang berwenang di Kaltara dan melaksanakan sumber daya pengawasan pekerja anak.

ABSTRACT

 This research delves into the supervision over children as young labor since this supervision is deemed not optimal in realizing children’s rights to work. Moreover, the lack of human resources involved in the supervision has made the children’s rights neglected since the provincial government of North Kalimantan is less supportive of the facilities and infrastructure required in the supervision. This issue certainly adds to existing impeding factors faced by the Labor and Transmigration Department of the province concerned, leading to a lack of supervision. Departing from this issue, this research investigates (1) how is the supervision over children as young labor performed to realize the protection of the children’s rights in the province of North Kalimantan? And (2) what are the impeding factors faced by the Labor and Transmigration Department in the Province of North Kalimantan during the supervision and what solutions can be given to this issue? This research employed empirical-juridical methods that involved a field study and socio-juridical approaches that see what takes place in real life. The research data were analyzed based on descriptive-qualitative methods. The research has found out that the supervision is not yet performed optimally recalling that impeding issues arise during the supervision. These issues involve the geographical condition of North Kalimantan province, the concealment of the data on children, lack of human resources responsible for the supervision, insufficient funds required to monitor young workers, and lack of facilities and infrastructure. Thus, it is essential to work in coordination with other authorized parties in the province and to execute the resources responsible for the supervision over the children involved as young workers.
