ABSTRAK

Arus Globalisasi memberikan dampak yang signifikan terhadap kebijakan-kebijakan yang diterapkan oleh Pemerintah, tak terkecuali Peraturan Presiden Nomor 21 Tahun 2016 Tentang Bebas Visa Kunjungan. Melalui aturan itu, Warga Negara Asing dapat melakukan kunjungan tanpa visa sebagai pengecualian terhadap warga negara asing dari negara-negara tertentu yang bermaksud mengadakan kunjungan ke wilayah Negara Kesatuan Republik Indonesia. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan Statute approach dan Case approach. Hasil penelitian menunjukan bahwa terdapat kekaburan hukum pada pengaturan terkait asas resiprositas dan asas manfaat. Perlu adanya tindakan preventif dan represif secara komprehensif, guna menyikapi adanya kemungkinan terganggunya stabilitas nasional. Oleh karena itu, urgensi diperlukannya penegasan pemaknaan terhadap asas resiprositas dan asas manfaat dalam kebijakan bebas visa kunjungan sehingga memiliki batasan-batasan terhadap negara-negara yang tercantum di dalam peraturan dan pengaktualisasian asas-asas tersebut demi tercapainya tujuan yang diharapkan

ABSTRACT

Globalization has significantly affected government policies, and Presidential Regulation Number 21 of 2016 concerning Visa-Free Visits is one of the affected. This regulation allows foreigners from certain countries to enter Indonesia with no visa required. This research employed normative-juridical methods, statutory, and case approaches. The research results indicate that there is the vagueness of norm in reciprocity and benefit principles. Preventive and repressive actions taken comprehensively are required to protect national stability. Thus, it is essential to review and assert the definition of reciprocity and benefit principles regarding visa-free visits by foreigners from certain countries to give clear scopes of the countries listed in the regulation concerned and for the actualization of those principles to reach objectives as expected
