ABSTRAK

Tujuan penelitian ini untuk menganalisis Peraturan Walikota Denpasar Nomor 37 Tahun 2018 tentang pengurangan penggunaan kantong plastik dengan Peraturan Gubenur Provinsi Bali Nomor 97 Tahun 2018 tentang pembatasan timbulan plastik sekali pakai. Jenis penelitian yang penulis pilih adalah yuridis normatif dengan metode pendekatan perundang-undangan (statute approach). Teknik analisis menggunakan interpretasi gramatikal dan interpretasi sistematis terhadap Peraturan Walikota Denpasar Nomor 37 Tahun 2018 dan Peraturan Gubenur Provinsi Bali Nomor 97 Tahun 2018 tentang pembatasan timbulan plastik sekali pakai. Berdasarkan hasil analisis implikasi dari penelitian ini yaitu terjadi pertentangan antara Peraturan Walikota Denpasar Nomor 36 Tahun 2018 tentang pengurangan penggunaan kantong plastik dengan Peraturan Gubernur Bali Nomor 97 Tahun 2018 tentang pembatasan timbulan plastik sekali pakai. Menurut teori tujuan hukum yang dikemukakan oleh Gustaf Radbruch aturan yang saling bertentangan maka keadilan, kemanfaatan serta kepastian hukum tersebut tidak terpenuhi, berdasarkan hal tersebut dapat dikatakan bahwa tujuan hukum dari Peraturan Walikota Denpasar Nomor 36 Tahun 2018 tentang penggunaan kantong plastik tidak dapat tercapai di masyarakat.

ABSTRACT

This research aims to analyse Mayor Regulation of Denpasar Number 37 of 2018 concerning the reduction of single-use plastic bags in comparison to the Governor Regulation of the Province of Bali Number 97 of 2018 concerning the restriction of single-use plastic bags. With a normative juridical method and statutory approach, this research obtained the data from the Mayor Regulation and Governor Regulation which was further analysed based on grammatical and systematic interpretation. The research reveals that conflicts between these two regulations arose. According to the theory of law introduced by Gustaf Radbruch, these two conflicting regulations will not be able to fulfil both justice and legal certainty. Similarly, the legal purpose of Mayor Regulation of Denpasar Number 36 of 2018 concerning the use of plastic bags is not reached.
