PERLINDUNGAN HUKUM BAGI KONSUMEN DALAM PENDANAAN JUAL BELI PROPERTI DENGAN SISTEM URUN DANA (CROWDFUNDING)

ABSTRAK

Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum preventif dan represif bagi konsumen dalam transaksi jual-beli properti dengan sistem urun dana dan tanggung jawab pengembang dalam hal terjadinya wanprestasi pengembang terhadap pendana dalam transaksi jual-beli properti dengan sistem urun dana. Alasan penulis ialah terdapat kekosongan hukum (rechvacuum) mengenai sistem urun dana (crowdfunding) bidang properti di Indonesia. Penelitian ini menggunakan metode yuridis normatif (normative legal research) dengan metode pendekatan perundang-undangan (statute approach), dan pendekatan konseptual (conseptual approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh peneliti akan dianalisis dengan menggunakan teknik analisis kualitatif dan interpretasi. Interprestasi yang digunakan ialah interprestasi sistematis dan gramatikal. Hasil dari skripsi ini adalah 1) Bentuk perlindungan hukum preventif bagi konsumen dalam transaksi jual-beli properti dengan sistem urun dana (crowdfunding) dalam peraturan perundang-undangan belum diatur secara khusus melainkan mengacu pada pada Peraturan OJK No. 77/POJK.01/2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi serta Peraturan OJK No. 37/POJK.04/2018 tentang Layanan Urun Dana Melalui Penawaran Saham Berbasis Teknologi Informasi, serta dalam bentuk perjanjian transaksi jual beli properti dengan sistem urun dana (crowdfunding) yang menjamin hak dan kewajiban masing-masing pihak dengan memperhatikan aspek-aspek hukum mengenai sistem urun dana (crowdfunding) bidang properti. Sedangkan, bentuk perlindungan represif bagi konsumen dalam transaksi jual-beli properti dengan sistem urun dana (crowdfunding) dapat ditempuh melalui dua jalur yaitu jalur litigasi melalui gugatan di badan peradilan umum atau melalui gugatan sederhana, dan jalur non litigasi melalui Badan Penyelesaian Sengketa Konsumen (BPSK) atau melalui Lembaga Alternatif Penyelesaian Sengketa-Sektor Jasa Keuangan (LAPS-SJK); 2) Tanggung jawab pengembang dalam hal terjadinya wanprestasi pengembang terhadap pendana dalam transaksi jual beli properti dengan sistem urun dana (crowdfunding) ialah pendana mempunyai hak untuk menjual properti dari pengembang untuk mengembalikan dana dan bunga atau pembagian hasil keuntungan yang seharusnya diterima pendana. Hal itu mengacu pada Pasal 32 POJK No 77/POJK.01/2016 yang memberikan hak kepada pendana untuk melakukan penjualan kepada ketiga baik secara privat maupun melalui pasar sekunder.

ABSTRACT

This study aims to analyze the form of preventive and repressive of legal protection for consumers in the transaction of buying and selling property through crowdfunding system and developer responsibilities when default happen over transaction of buying and selling property through crowdfunding system. The author's reason is that there is a vacuum of law (rechvacuum) regarding the property crowdfunding system in Indonesia. This research uses a normative legal research with statute and conceptual approaches. The primary, secondary, and tertiary legal materials obtained by the authors will be analyzed using qualitative analysis and interpretation technique. The interpretations used are systematic and grammatical interpretations. The results of this thesis show: 1) The form of preventive legal protection for consumers in the transaction of buying and selling property through crowdfunding system in the statutory regulations has not been specifically regulated but refers to the OJK Regulation No. 77 / POJK.01 / 2016 concerning Information Technology-Based Lending Services and OJK Regulation No. 37 / POJK.04 / 2018 concerning Crowdfunding Services Through Information Technology Based Shares, as well as in the form of real estate sale and purchase agreement through crowdfunding system that guarantees the rights and obligations of each party by taking into account legal aspects of crowdfunding system in the filed of property. Meanwhile, the form of repressive protection for consumers in buying and selling property through crowdfunding system can be pursued through two paths, namely the litigation through a lawsuit in the local court or through a simple lawsuit, and the non-litigation through the Consumer Dispute Resolution Body (BPSK) or through Alternative Dispute Resolution Institution in Financial Services Sector (LAPS-SJK); 2) The responsibility of the developer when the default happen against creditor in the transaction of buying and selling property through crowdfunding system which is the creditor has the right to sell the property from the developer to return the funds and interest or share the profits that the creditor should receive. This solution refers to Article 32 of POJK No. 77 / POJK.01 / 2016 which gives the right for creditor to make sales to third party either privately or through the secondary market.
