PERAN KEPALA DESA TROJALU DALAM MENGATASI PERMASALAHAN PEMANFAATAN TANAH HAK MILIK UNTUK KEPERLUAN FUNGSI SOSIAL ( Studi Kasus Di Kantor Desa Trojalu )

ABSTRAK

Desa merupakan kesatuan masyarakat hukum yang memiliki batas wilayah yang berwenang untuk mengatur dan mengurus urusan pemerintahan serta kepentingan masyarakat setempat berdasarkan prakarsa masyarakat, hak asal usul, dan/ atau hak tradisional yang diakui dan dihormati dalam sistem pemerintahan Negara Kesatuan Republik Indonesia. Peran Kepala Desa Trojalu dalam pemanfaatan tanah hak milik sebagai fungsi sosial sangat penting dengan adanya kesadaran hokum masyarakatnya. Masih banyak masyarakat yang menentang Pasal 6 UUPA ( Peraturan Dasar Pokok - Pokok Agraria) tentang asas fungsi sosial tanah. Berdasarkan hal tersebut, karya tulis ini menggunakan metode penelitian yang di gunakan adalah penelitian empiris dengan terjun langsung di Kantor Kepala Desa untuk mengetahui peran kepala desa trojalu dalam mengatasi permasalahan pemanfaatan tanah hak milik untuk keperluan fungsi social. Hasilnya Peran Kepala Desa Trojalu adalah memberikan edukasi kepada masyarakat, melakukan musyawarah desa dan melakukan negosiasi hingga mencapai kesepakatan. Dalam mengatasi permasalahan tersebut, Desa Trojalu menyelesaikan dalam waktu 1 minggu asalkan dengan kesepakatan bersama.

ABSTRACT

Village is a community with its territorial borders that allow authorities to run government and the interest of the community members according to the initiation of the members, the rights of origin, and/or traditional rights recognised and respected in the governmental system of the Unitary State of the Republic of Indonesia. With the awareness of the local law among the people, the role of the Village Head of Trojalu in utilising the land under ownership right for social purpose is deemed to be important. Most people, however, stand against Article 6 of Basic Agrarian Law (UUPA) concerning the principles of social function of land. Departing from this issue, this study aims to find out the role of the village Head of Trojalu in tackling the issue in the utilization of the land as specified above by conducting observation in the office of Village Head based on empirical approach. The results of the study have found out that the Head of Trojalu has educated the members of the community through deliberation and negotiation to come to an agreement. To tackle this issue, it is agreed that it should take one week for Trojalu village to settle the dispute under mutual agreement.
