ABSTRAK

Penelitian ini difokuskan pada permasalahan yang dilatar belakangi denganditerbitkannya Peraturan Kejaksaan Nomor 15 Tahun 2020 Tentang PenghentianPenuntutan Berdasarkan Keadilan Restoratif merupakan suatu kebijakan baru dalamlingkup Penuntutan, yakni menerapkan penghentian penuntutan didasarkan padakeadilan restoratif. Tujuan dilakukannya penelitian ini yakni Untuk mengetahuibagaimana penerapan Penghentian Penuntutan Berdasarkan Keadilan Restoratifsebagaimana diatur dalam Peraturan Kejaksaan Nomor 15 Tahun 2020 tentangPengentian Penuntutan Berdasarkan Keadilan Restoratif di Kejaksaan NegeriGunungkidul serta untuk mengetahui kendala dan solusi dalam pelaksanaanpenghentian Penuntutan  berdasarkan Peraturan Kejaksaan Nomor 15 Tahun 2020tentang Pengentian Penuntutan Berdasarkan Keadilan Restoratif di Kejaksaan NegeriGunungkidul. Penelitian ini merupakan penelitian yuridis empiris, yang menggunakanpendekatan yuridis sosiologis. Kemudian dalam pelitian ini menggunakan Teknikpengambilan data primer melalui wawancara dengan responden, dan juga Tekniksekunder diperoleh melalui studi dokumen.

Abstract

This research was focused on the issue that was motivated by the issuance of Prosecutor'sRegulation of the Republic of Indonesia Number 15 of 2020 concerning Cessation ofProsecution based on Restorative Justice. It is a new provision within the scope ofprosecution, namely the implementation of cessation of prosecution based on restorativejustice. The aim of this research is to find out how to implement cessation of prosecutionbased on restorative justice as stipulated in Prosecutor's Regulation Number 15 of 2020concerning Cessation of Prosecution based on Restorative Justice at State Prosecutor's Office of Gunungkidul and to understand the obstacles and its solutions in theimplementation of cessation of prosecution according to Prosecutor's Regulation Number 15of 2020 concerning Cessation of Prosecution based on Restorative Justice at State Prosecutor's Office of Gunungkidul. This research is empirical legal research usingsociological juridical approach. Furthermore, the primary data was collected throughinterviews with respondents and the secondary data obtained through document studies.
