PENGHAPUSAN RED NOTICE TERKAIT TINDAK PIDANA KORUPSI DALAM ICPO-INTERPOL (STUDI KASUS JOKO TJANDRA)

ABSTRAK

Penelitian ini mengkaji dan menjawab mengenai penghapusan Red Notice atas nama Joko Soegiarto Tjandra No. Alert : A-1-1897/7-2009 dalam International Criminal Police Organzation (ICPO) atau yang lebih dikenal dengan sebutan Interpol. Dalam penulisan ini, penulis menggunakan metode penelitian normatif, dimana data yang diperoleh dikumpulkan kemudian dianalisis yang kemudian dijadikan rujukan dalam memecahkan masalah. Terpidana kasus korupsi PT. Bank Bali, Tbk atas putusan Mahkamah Agung RI, Joko Soegiarto Tjandra, telah masuk Daftar Pencarian Orang (DPO) dan memiliki status Red Notice yang diterbitkan oleh NCB-Interpol Indonesia. Setelah 11 tahun menjadi buron negara Indonesia, pada tahun 2020 silam baru diketahui bahwa status Red Notice atas nama Joko Soegiarto Tjandra tersebut terhapus dari sistem I-24/7 Interpol pada tahun 2019. Dari hasil penelitian dan pembahasan mengenai penghapusan status Red Notice tersebut, diperoleh kesimpulan bahwa 1) Terjadi pelanggaran yang dilakukan oleh NCB – Interpol Indonesia karena tidak memperpanjang status Red Notice tersebut, 2) Dasar penghapusan dari Interpol sendiri ialah apabila tujuan penerbitan Red Notice tidak sesuai dengan tujuan Interpol, dan 3) Akibat hukum penghapusan ialah memperhambat jalannya eksekusi dan penangkapan Joko Soegiarto Tjandra.

ABSTRACT

This research studies and observed the revocation of red notice on behalf of Joko Soegiarto Tjandra No. Alert: A-1-1897/7-2009 in International Criminal Police Organization (ICPO) or Interpol, with normative method where data was collected and analysed as a reference to resolve the problem. The defendant Joko Soegiarto Tjandra involved in corruption case of PT. Bank Bali, Tbk, under Supreme Court Decision, has been fugitive with red notice status issued by NCB-Interpol Indonesia. After 11 years of being fugitive in Indonesia, in 2020, his Red Notice status of Joko Soegiarto Tjandra was found clear of the system I-24/7 Interpol in 2019. This revoked red notice indicates that 1) there was infringement committed by NCB- Interpol Indonesia as the Red Notice was not extended, 2) this revocation done by the Interpol was based on the condition where Red Notice was not relevant to the objectives of Interpol, and 3) the legal implication of this revocation is that the apprehension of Joko Soegiarto Tjandra might be interrupted.
