ABSTRAK

Penelitian ini bertujuan agar mengetahui penerapan dari Pasal 4 Ayat 1 Peraturan Daerah Kabupaten Malang Nomor 8 Tahun 2019 Tentang Perubahan Atas Peraturan Daerah Nomor 3 Tahun 2013 Tentang Tanda Daftar Usaha Pariwisata. Meski sudah diatur jelas mengenai aturan dan juga sanksi bagi pengusaha wisata tirta yang melanggar, namun dalam kenyataannya masih terdapat pengusaha wisata tirta yang tidak memiliki izin usaha. Sehingga tujuan dari penelitian ini untuk menjelaskan factorfactor penghambat dari Pasal 4 Ayat 1 Peraturan Daerah Kabupaten Malang Nomor 8 Tahun 2019 Tentang Perubahan Atas Peraturan Daerah Nomor 3 Tahun 2013 Tentang Tanda Daftar Usaha Pariwisata. Pendekatan ini dilakukan dengan menggunakan pendekatan Socio legal. Hasil dari penelitian ini menyimpulkan bahwa hukum yang berlaku sudah cukup baik, namun factor penegak, factor masyarakat, dan factor budaya yang masih harus ditingkatkan, hal ini yang menyebabkan penerapan pasal ini kurang berjalan secara efektif. Upaya yang dilakukan oleh Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu sudah cukup baik dan sudah tepat dalam pelaksanaannya tetapi masih dapat ditingkatkan lagi.

ABSTRACT

This study aims to determine the application of Article 4 Verse 1 of Malang Regency Regional Regulation Number 8 of 2019 concerning Amendments to Regional Regulation Number 3 of 2013 concerning Tourism Business Registry Numbers. Even though it has been clearly regulated regarding the rules and sanctions for water tourism entrepreneurs who violate it, in reality there are still water tourism entrepreneurs who do not have a business license. So that the purpose of this study is to explain the inhibiting factors of Article 4 verse 1 of Malang Regency Regional Regulation Number 8 of 2019 concerning amendment to Regional Regulation Number 3 of 2013 concerning Tourism Business Registry Numbers. This approach is carried out using the Socio Legal approach. The results of this study conclude that conclude the appcable law is quite good, but the enforcing factor, the community factor, and the cultural factor still need to be improved, this is why the application of this article is not effective. The efforts made by the Investment Service and One Stop Integrated Service are quite good and have been properly implemented, but can still be improved.
