PENERAPAN PASAL 8 HURUF A PERATURAN DAERAH NOMOR 3 TAHUN 2009 TENTANG BANGUNAN GEDUNG TERKAIT PENDIRIAN RUMAH MAKAN DI KAWASAN WISATA TELAGA NGEBEL KABUPATEN PONOROGO

ABSTRAK

Telah ditegaskan pada Pasal 8 Huruf A Perda No. 3 Tahun 2009 bahwa setiap bangunan yang akan dibangun di Kabupaten Ponorogo diharuskan untuk memiliki IMB. Namun keharusan memiliki IMB tidak dapat dilaksanakan secara optimal, mengingat masih banyaknya bangunan gedung di sekitar kawasan wisata Telaga Ngebel, Kabupaten Ponorogo yang dibangun tanpa mengikuti prosedur IMB. Tujuan penelitian ini dilakukan untuk mengetahui dan menganalisa penerapan Pasal 8 Huruf A Peraturan Daerah Nomor 3 Tahun 2009 tentang Bangunan Gedung terkait pendirian rumah makan di kawasan wisata Telaga Ngebel Kabupaten Ponorogo termasuk hambatan dan solusi dalam penerapan pasal tersebut. Penelitian ini menggunakan metode penelitian sosio legal dengan metode pendekatan yuridis sosiologis. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Penerapan Pasal 8 Huruf A Peraturan Daerah Nomor 3 Tahun 2009 tentang Bangunan Gedung masih belum efektif dikarenakan rumah makan yang berdiri di sepanjang bibir Telaga Ngebel Kabupaten Ponorogo tidak memiliki Izin Mendirikan Bangunan. Rumah makan tersebut telah berdiri dan beroperasi bertahun-tahun lamanya tetapi masih belum ada tindakan tegas dari pemerintah daerah dan belum mendapatkan sanksi sebagaimana yang ditegaskan pada Pasal 64 Peraturan Daerah Nomor 3 Tahun 2009 tentang Bangunan Gedung. Sedangkan hambatan dalam penerapan pasal tersebut diakibatkan oleh faktor  aparat pemerintah, sarana prasarana dan budaya masyarakat. Solusi dalam menangani hambatan yang terjadi adalah dengan melaksanakan sosialisasi Peraturan Daerah Nomor 3 Tahun 2009 tentang Bangunan Gedung, meningkatkan kualitas sumber daya manusia, meningkatkan sarana dan pra sarana penunjang, dan meningkatkan sistem pengawasan dan penegakkan hukum.

ABSTRACT

In Article 8 Letter A Perda No. 3 of 2009 said that every building to be built in Ponorogo Regency is required to have an IMB. However, the need to have an IMB cannot be implemented optimally, considering that there are still many buildings around the Ngebel Lake tourist area, Ponorogo Regency that were built without following the IMB procedure. The purpose of this study was to determine and analyze the application of Article 8 Letter A of Regional Regulation Number 3 of 2009 concerning Buildings related to the establishment of restaurants in the Ngebel Lake tourist area, Ponorogo Regency, including obstacles and solutions in implementing the article. This study uses a socio-legal research method with a sociological juridical approach. From the results of the research with the method above, the writer gets the answer to the existing problem that the application of Article 8 letter A of Regional Regulation Number 3 of 2009 concerning Buildings is still not effective because the restaurant that stands along the lip of Ngebel Lake, Ponorogo Regency does not have a Building Construction Permit. The restaurant has been established and operated for years but there is still no firm action from the local government  and has not received any sanctions as emphasized in Article 64 of Regional Regulation Number 3 of 2009 concerning Buildings. Meanwhile, obstacles in the application of these articles are caused by factors of government officials, infrastructure and community culture. The solution in dealing with the obstacles that occurs is by implementing the socialization of Regional Regulation Number 3 of 2009 concerning Buildings, improving the quality of human resources, improving supporting facilities and infrastructure, and improving the supervision and law enforcement system.
