Abstrak

Penelitian ini bertujuan untuk mengetahui pengaturan indirect expropriation dalam penanaman modal asing berdasarkan hukum ekonomi internasional. Dalam hukum internasional, konsep pengambilalihan terhadap perusahaan investor asing sudah dikenal sejak lama.  Hingga saat ini pengaturan mengenai indirect expropriation dalam hukum internasional dinilai masih tidak konsisten. Hingga saat ini tribunal dalam menyelesaikan sengketa investasi antara negara dan investor masih menerapkan pendekatan dan standar yang berbeda-beda dalam menganalisis tindakan indirect expropriation. Skripsi ini mencoba menganalisis ruang lingkup pengaturan indirect expropriation dengan menganalisis BIT, FTA dan putusan sengketa antara negara dengan investor mengenai indirect exprop riation dan menganalisis urgensi dari pengaturan indirect expropriation.

Abstract

This study aims to determine the regulation of indirect expropriation in foreign investment based on international economic law. In international law, the concept of expropriation over foreign investor company has been known for a long time. Up till now, the regulation on indirect expropriation in international law is considered to be inconsistent. Until now, the tribunal in resolving investment disputes between the state and investors still applies different approaches and standards in analyzing indirect expropriation. This bachelor thesis tries to analyze the scope of indirect expropriation arrangements by analyzing BIT, FTA and dispute decisions between countries and investors regarding indirect expropriation and analyzing the urgency of regulations on indirect expropriation.
