Abstract

Law No. 36 of 2009 concerning health set penalties for dealers, sellers of prescription drugs without a license (Pil LL) as where listed didalm Article 196 and Article 197 of Law No. 36 of 2009. However, the Act No. 36 of 2009 has not been set on the regulation / rule regarding harsh penalties for drug users without the consent of the eligible .This writing aims to analyze the policy formulation for pill users in order to prevent the use of LL pills. This paper is based normative research, the approach of legislation, comparative approaches and conceptual approaches. The study / research shows that Law no. 36 of 2009 on health have not been able to provide protection, justice and security for users LL pill, because the pattern of criminal acts less assertive formulation and oriented only to the seller and pengedarnya alone. In order ensuring certainty and fairness in law enforcement in preventing unauthorized users LL pill, it needs to make rules / regulations more attention to the LL pill users without permission.

Abstrak

UU no 36 tahun 2009 tentang kesehatan mengatur mengenai sanksi bagi pengedar, penjual obat keras tanpa ijin ( Pil LL ) sebagai mana tercantum didalm pasal 196 dan pasal 197 UU no 36 tahun 2009. Tetapi UU no 36 tahun 2009 belum mengatur mengenai regulasi / aturan mengenai sanksi bagi pengguna obat keras tanpa ijin dari yang berhak. Tulisan ini bertujuan untuk menganalisa kebijakan formulasi terhadap pengguna pil LL dalam rangka pencegahan penggunaan pil LL. Tulisan ini dibuat berdasarkan penelitian normatif, dengan pendekatan perundang-undangan, pendekatan komparatif dan pendekatan konseptual. Hasil kajian/ penelitian menunjukkan bahwa UU no. 36 tahun 2009 tentang kesehatan belum dapat memberikan perlindungan, keadilan dan keamanan bagi pengguna pil LL, karena pola perumusan tindak pidananya kurang tegas dan hanya berorientasi kepada penjual dan pengedarnya saja. Agar terjaminnya kepastian dan keadilan di dalam penegakkan hukum dalam upaya pencegahan pengguna pil LL tanpa ijin, maka perlu dibuat aturan / regulasi yang lebih memperhatikan terhadap pengguna pil LL tanpa ijin.
