PENERAPAN RESTORATIF JUSTICE DALAM PENYELESAIAN KASUS KECELAKAAN LALU LINTAS

Abstract

Abstract

As an illustration and phenomena at the level of completion of a traffic accident police investigation into the accident as well the impact the death of the victim, or a physical disability, has sought to use mediation in resolving the case of an accident. The accident, police have attempted to perform penal mediation. This study aimed to analyze the case of traffic accidents were solved with restorative justice approach and whether consideration of the investigator using a restorative justice approach to resolve the case of traffic accidents. The research is a normative law.

From research conducted in the know that in the resolution of cases of traffic violations that occur in the Police Samarinda, then the best way is to apply the completion of restorative justice (fairness restorative) that bring together the perpetrator-victim, and the family to resolve the dispute witnessed by Police local. And investigators consider the need for restorative justice approach in the case of a traffic accident based on mutual respect between the victim-offender to avoid buildup / disputes in the future.

Sebagai gambaran dan fenomena pada tataran penyelesaian kecelakaan lalu lintas Polri selaku penyidikan dalam kecelakaan tersebut baik yang berdampak meninggalnya korban, atau mengalami cacat fisik, telah berupaya untuk menggunakan mediasi dalam menyelesaikan kasus kecelakaan. Kecelakaan tersebut, Polri telah berupaya untuk melakukan mediasi penal. Penelitian ini bertujuan untuk menganalisis perkara kecelakaan lalu lintas yang diselesaikan dengan pendekatan keadilan restorative dan apakah pertimbangan penyidik menggunakan pendekatan keadilan restoratif untuk menyelesaikan perkara kecelakaan lalu lintas. Jenis penelitian ini adalah hukum normatif.

Dari penelitian yang dilakukan di ketahui bahwa       dalam penyelesaian perkara pelanggaran lalu lintas yang terjadi di Polres Samarinda, maka jalan yang  terbaik adalah dengan menerapkan penyelesaian restorative justice (keadilan  restorative) yaitu mempertemukan antar pelaku-korban, dan pihak keluarga untuk  menyelesaikan perselisihannya dengan disaksikan oleh Polisi setempat. Dan Penyidik mempertimbangkan perlunya pendekatan restorative justice dalam perkara kecelakaan lalu lintas didasarkan pada saling menghormati antara korban-pelaku  agar tidak terjadi penumpukan/perselisihan yang terjadi dikemudian hari.
