On January 29, 2008 PT. Budi Duta Agro Makmur apply for Extension of Time HGU Land to the National Land Agency of East Kalimantan Province , the first to be berahkir rights on December 31, 2010. This study aimed to analyze the extension of the concession through the Committee and in accordance with the requirements signaled in Government Regulation No. 40 1996 on HGU , HGB and the Right to Use Land . And aims to analyze the general principles of good governance in accordance with Law No. 28 Year 1998 regarding the State The Clean and Free from Corruption , Collusion Nepotism in the extension Hak Guna Usaha ( HGU ) conducted by the committee and can be implemented . The research is a normative law.

Results from this study showed that the extension Hak Guna Usaha (HGU) by the committee and in accordance with the requirements, but in the process of granting land use permits no faulty procedure. Pada tanggal 29 Januari 2008 PT. Budi Duta Agro Makmur mengajukan permohonan Perpanjangan Waktu HGU Atas Tanah kepada Badan Pertanahan Nasional Provinsi Kalimantan Timur, pertama akan berakhir haknya pada tanggal 31 Desember 2010. Penelitian ini bertujuan untuk menganalisis perpanjangan HGU Melalui Panitia B Sesuai dengan persyaratan yang di isyaratkan dalam Peraturan Pemerintah Nomor 40 Tahun 1996 tentang HGU, HGB dan Hak Pakai Atas Tanah. Dan bertujuan untuk menganalisis asas-asas umum penyelenggaraan pemerintahan yang baik menurut Undang-Undang Nomor 28 Tahun 1998 tentang Penyelenggaraan Negara Yang Bersih dan Bebas Korupsi Kolusi Nepotisme dalam perpanjangan Hak Guna Usaha (HGU) yang dilakukan oleh panitia B dapat dilaksanakan. Jenis penelitian ini adalah hukum normatif.

Hasil dari penelitian ini menunjukan bahwa perpanjangan Hak Guna Usaha (HGU) oleh panitia B sesuai dengan persyaratan, tetapi di dalam proses pemberian izin Hak Guna Usaha ada yang cacad prosedur. Cacad dalam rangkaian tahapan proses administrasi, berdasarkan Risalah Panitia Pemeriksaan tanah B Nomor: 540.2/15/RPT.PAN.BN/V/2008 dan Risalah Pengelolaan Data (RPD) KANWIL BPN Provinsi Kalimantan Timur. Dan Panitia B terdapat asas yang dilanggar yaitu asas profesionalis dan asas akuntabilitas di mana terdapat sengaja tidak dapat dipertanggungjawabkan, dibuktikan adanya kehendak membuat secara palsu untuk memalsukan surat dapat menimbulkan suatu kerugian.  ketentuan Peraturan Kepala BPN Nomor 7 Tahun 2007 tentang Panitia Pemeriksaan Tanah.
